Aadhaar eSign or Aadhaar based eSignature is an electronic way to sign PDF documents using an Aadhaar number.
Aadhaar based eSignature was introduced in 2015 - by virtue of Schedule 2 of the IT Act read with Section 3A - as a legal and compliant mode of signing documents electronically. Under S. 5 of the IT Act, signatures like Aadhaar eSign hold the same “validity” as a wet-ink signature. Since then, it has become one of the most popular methods of eSigning in India - due to its ease of use. An Aadhaar card holder can eSign a document from anywhere, anytime as long as they have:
- An Aadhaar number
- Phone or email linked to this aadhaar number
Once an Aadhaar holder receives a signing link (facilitated by an ASP interface) - they can complete the electronic signature via an “on-the-fly” Aadhaar eKYC authentication (usually via OTP authentication - but also possible via Biometric and Iris authentication). Upon a valid success response to the authentication - an Electronic Signature Certificate is generated and affixed to the document being signed.
The 4 Key Benefits of Aadhaar eSign over other eSign methods:
Aadhaar eSign is a revolutionary process of electronically signing a document - with major advantages over other eSign modes:
Zero procurement hassle - The beauty of using Aadhaar eSign is that if you have an Aadhaar number linked to a mobile/email - you can sign from anywhere and anytime. You do not have to go through the hassle of procuring or purchasing a physical digital signature token
Accessible & convenient - As long as you have a valid Aadhaar number, a linked mobile/email and a working Internet connection - you can sign from anywhere in the world.
Accessible on phone - Unlike traditional digital signatures - which require laptop/desktop access - Aadhaar eSign can be performed on an Internet enabled smart phone or tablet. This is vital for India - where most Indians access the Internet via smartphones.
Legally secure- Apart from its clear validity under the IT Act - signatures like Aadhaar eSign also have presumptions of validity under the Evidence Act. This makes them the gold standard of enforceability for any signature type in India. If Aadhaar eSign was the primary mode of signing in India - you would probably see faster enforcement of contracts
